Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Pythia platform operated by Pythia ("we", "us", or "our"). By accessing or using Pythia, you agree to be bound by these Terms. If you do not agree, do not use the platform.
1. Description of the service
Pythia is a personality assessment platform that enables organisations to analyse interview recordings and generate Big Five (NEO) personality profiles for the purpose of hiring and talent evaluation. The platform serves two categories of users:
- Managers — individuals acting on behalf of an organisation who create job postings, invite candidates, conduct recorded interviews, and review personality reports.
- Candidates — individuals who are invited to participate in an interview assessment and may view their own results.
2. Eligibility and accounts
- You must be at least 18 years old to create an account or participate in an assessment.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- You must provide accurate and complete information when registering. Impersonating another person or organisation is prohibited.
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. Acceptable use
You agree to use Pythia only for lawful purposes and in accordance with these Terms. You must not:
- Use the platform to discriminate against candidates on the basis of protected characteristics (race, sex, age, disability, religion, national origin, or any other characteristic protected by applicable law).
- Record an interview without first informing the candidate that a recording will take place.
- Share personality reports with parties outside the authorised hiring team without the candidate's consent.
- Attempt to reverse-engineer, scrape, or interfere with the platform or its underlying systems.
- Upload content that is unlawful, harmful, or infringes the intellectual property rights of others.
- Use automated tools to access the platform in any manner not expressly permitted by us.
4. Recording and consent obligations
Managers who initiate interview recordings are solely responsible for ensuring that all applicable recording consent laws are observed. Requirements vary by jurisdiction — for example, some regions require the explicit consent of all parties to a conversation before recording.
By using the recording feature, you represent and warrant that:
- You have obtained any legally required consent from all participants before starting a recording.
- You have clearly informed the candidate that the interview may be recorded and used for personality assessment purposes.
- You will use recordings only for the hiring and assessment purposes stated to the candidate.
We accept no liability for recordings made without proper consent. Violations of recording consent law are the sole responsibility of the manager and their organisation.
5. Personality assessments — limitations and appropriate use
Personality scores produced by Pythia are statistical estimates derived from audio analysis. They are intended as one input among many in a hiring decision and must not be used as the sole or determinative basis for any employment decision. You acknowledge that:
- No personality assessment tool is perfectly accurate or free from potential bias.
- Results may be affected by recording quality, language, and other contextual factors.
- Pythia's outputs do not constitute psychological, medical, or legal advice.
- Organisations remain solely responsible for compliance with employment and anti-discrimination law in their jurisdiction.
6. Intellectual property
All software, algorithms, models, designs, and content comprising the Pythia platform are owned by us or our licensors and are protected by copyright, trade secret, and other intellectual property laws. These Terms do not grant you any ownership interest in the platform.
You retain ownership of any audio recordings you upload. By uploading a recording, you grant us a limited, non-exclusive licence to process the recording solely for the purpose of generating the personality report for your assessment. We will not use your recordings for any other purpose without your separate written consent.
7. Data and privacy
Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Pythia, you consent to the data practices described in the Privacy Policy.
Managers who use Pythia on behalf of an organisation act as data controllers in respect of candidate personal data they collect, and Pythia acts as a data processor. Organisations are responsible for providing appropriate privacy notices to candidates and for ensuring a lawful basis for processing before using our services.
8. Disclaimers
The platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free from harmful components. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the platform — including but not limited to loss of profits, loss of data, or harm resulting from hiring decisions made using our personality reports.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or the platform shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) €100.
10. Indemnification
You agree to indemnify and hold harmless Pythia and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any applicable recording consent or employment law; or (d) any hiring decision you make using our services.
11. Termination
Either party may terminate these Terms at any time. You may close your account by contacting us. We may suspend or terminate your access immediately if we reasonably believe you have violated these Terms, applicable law, or the rights of a third party. On termination, your right to access the platform ceases immediately. Sections 6, 8, 9, 10, and 13 survive termination.
12. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice on the platform at least 14 days before they take effect. Continued use of Pythia after the effective date constitutes acceptance of the revised Terms. If you do not accept the changes, you must stop using the platform and close your account.
13. Governing law and disputes
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Pythia is registered, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the platform will first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of that jurisdiction.
